Litigation between NEXON and IRONMACE over the theft of Project P3 game data during the development of Dark and Darker continues. In March 2023, NEXON filed a US copyright infringement complaint against IRONMACE and notified Valve to block the game from Steam.
The plaintiff planned to achieve a ban on the distribution of the game specifically in the United States and thereby close access to all the most popular game distribution services. The defendant was betting that the US court is not the best place for such a trial, and everything should be decided by the court of South Korea: all participants are in South Korea, all the evidence is in Korean, the trials are already coming to an end, etc.
After reviewing the parties’ arguments, the US court decided to dismiss NEXON’s complaint and grant IRONMACE’s motion to dismiss the case. Now there are no barriers to the release of Dark and Darker on Steam. But, most likely, all parties will wait for the outcome of the legal proceedings in South Korea.
