South Korean court rejects Nexon's ban on publishing Dark and Darker, but proceedings continue

The trial between Nexon and IRONMACE over the theft of Project P3 data during the development of Dark and Darker has seen the first results. It became known that the court recognized the arguments voiced by Nexon as valid, but decided to “consider the case on its merits” and not at the stage of a preliminary injunction.

Now IRONMACE can release the game in South Korea, but there is no need to rejoice at this victory ahead of time. Nexon is confident that it will be able to prove the fact of illegal borrowing of game elements. In addition, such a court decision indicates, at a minimum, that there are doubts about the innocence of the Dark and Darker developers.

Dark and Darker is a first-person PvPvE action game developed by the South Korean studio IRONMACE. The game aroused great interest among players even at the time of the first public tests, and Nexon saw in the game the theft of game assets and elements by its former developers. The investigation into the matter began back in August 2021 when Nexon filed a police report. A year later, the case was transferred to the prosecutor’s office, after which two searches were carried out at Iron Mace.
